Terms & Conditions (Enrollment & App Agreement)

These Terms & Conditions (the “Agreement”) govern participation in any swim lesson, program, camp, class, event, or service offered by Marina Swim School (“MSS”, “we”, “us”, or “our”), as well as use of the Marina Swim School mobile application (“App”) and website.

By enrolling yourself or a minor child, booking a class, attending an MSS facility, or using our App/website, you agree to be legally bound by these Terms.
If the participant is a minor (under 18), the legal parent/guardian must agree to these Terms on the minor’s behalf.


1. Eligibility for Swim Lessons

  • Infant lessons: 3 months and up

  • Children’s lessons: 3 months–12 years

  • Adult lessons: 13+ years

We reserve the right to refuse service to anyone for reasons related to safety, facility rules, or compliance.


2. Payments, Billing & Fees

2.1 Accepted Payment Methods

Payments may be made via:

  • Credit/debit card

  • Approved processors (e.g., Square, Bambora)

  • Online booking system or App

We do not store full credit card numbers.

2.2 Automatic Billing (If Applicable)

Some programs require recurring or installment payments.
You will be notified before automatic billing occurs.


3. Cancellation, Refund & Hold Policy

3.1 Prolonged Absences / Holiday Holds

  • Holds must be requested in writing 72 hours before the absence.

  • A $75 hold fee applies.

  • Remaining lessons are credited to your MSS account for 12 months.

  • No refunds for holds.

  • Past missed classes cannot be credited retroactively.

  • Instructor/schedule cannot be guaranteed upon return.

3.2 Medical Holds

  • Email us with a doctor’s note dated the same week as the request.

  • Medical holds are free.

  • Missed lessons credited for 12 months.

  • No refunds.

3.3 Refund Policy

Trial Classes

  • No refunds for cancellations.

  • If rescheduled 48+ hours in advance, credit is valid for 3 months.

Deposits

  • All deposits (for sessions, camps, etc.) are non-refundable.

  • Unused balances credited for 12 months.

Swimming Packages / Camps

  • Once the term begins, no refunds.

  • Packages may be transferred to a family member or put on hold for 12 months.

  • Cancellations within 2 weeks of start date receive no refund.

  • All approved refunds carry a $65 administration fee.

3.4 Makeup Lesson Policy

How to Request

  1. Email reception to request a Makeup Lesson Application Form (1 week before).

  2. Submit the completed form.

  3. Confirmation will be sent within 24 hours.

Makeup Lesson Rules

  • Each makeup lesson costs $15.

  • Free makeup only with a doctor’s note (dated same week).

  • Missed makeup lessons are forfeited; a new paid makeup is required.

  • Makeups depend on availability and are not guaranteed.

  • Must be used within the same session.

  • Not transferable.

Program-Specific Rules

  • Group Lessons: Max 2 per session; $15 each.

  • Private/Semi-Private: Makeups occur in group classes; 1 free makeup per package.

  • Family Class Packages: No makeup lessons.


4. Service Interruptions

4.1 Facility Closures / Power Outages

If MSS cancels a class due to outages, pool issues, or emergencies:

  • A makeup class or credit (valid 12 months) will be issued.

  • Refunds are not provided.

4.2 Snow Days

  • MSS remains open unless we officially cancel.

  • If we cancel: makeup or credit provided.

  • If we remain open: absences do not qualify for refunds or makeups.

4.3 Equity, Diversity & Inclusion

MSS provides an inclusive, respectful environment for all individuals regardless of culture, identity, ability, or background.


5. Safety Rules

All participants must follow:

  • Instructor directions

  • Pool and facility rules

  • Safety protocols

Failure to comply may result in removal without refund.


6. Health Requirements

Participants must not attend with:

  • Contagious illness

  • Open wounds

  • Medical conditions that make swimming unsafe

Parents must disclose any relevant physical, medical, or behavioral conditions.


7. Assumption of Risk & Liability Waiver

Swimming and aquatic activity involve inherent risks, including drowning, slips, falls, and injuries.

By enrolling or participating, you agree that:

  • You voluntarily assume all risks of participation.

  • MSS, its owners, directors, employees, contractors, and facility partners are not liable for injuries, damages, or losses.

  • You release MSS from any claims arising from participation.

  • You agree to indemnify MSS for claims resulting from your breach of these Terms or unsafe conduct.

If you do not agree, do not enroll or participate.


8. Parent/Guardian Responsibilities

Parents/guardians must:

  • Stay onsite unless instructed otherwise

  • Ensure punctual arrival

  • Supervise children before and after lessons

  • Provide proper swimwear and hygiene


9. Photo & Video Consent

  • MSS may record photos/videos for training, operations, or marketing.

  • You may opt out via written request.

  • No compensation is provided for recorded material.


10. Mobile App & Website Use

10.1 Account Registration

Users must:

  • Provide accurate information

  • Keep credentials confidential

  • Notify us of unauthorized access

MSS is not responsible for damages due to compromised accounts.

10.2 Acceptable Use

You agree NOT to:

  • Use the App for unlawful or harmful purposes

  • Harass, threaten, or abuse others

  • Impersonate another person

  • Upload inappropriate or unauthorized content

  • Attempt to hack, disrupt, reverse-engineer, or damage the App

Violation may result in account suspension or termination.


11. Payments via App

11.1 Third-Party Payment Processing

Payments are processed securely by Square, Bambora, and similar providers.
Your card data is sent directly to them; we do not store it.

You agree to the terms of the payment processor used.

11.2 Payment Issues

Failed payments may result in:

  • Class cancellation

  • Account suspension

MSS is not liable for bank or card issuer fees.


12. Cancellation & Refunds via App

By booking through the App, you agree to all policies listed in Section 3 and the detailed policy on our website.

Refunds (if eligible):

  • Are issued to the original payment method

  • May take time depending on processors/banks

  • May be subject to admin fees

No-shows or late cancellations forfeit the class fee.

Emergency medical situations may receive flexibility at MSS discretion.


13. Data Privacy & Security

  • Personal data is collected to operate MSS services.

  • Use of your data is governed by our Privacy Policy
    (www.marinaswimschool.com/Terms and conditions).

  • We share information only with authorized service providers (e.g., payment processors).

  • MSS uses reasonable security measures but cannot guarantee absolute security.

  • Parents consent to collection of minor data for registration.


14. User Content

Any content you upload (profile photos, messages, etc.):

  • Remains your property

  • Grants MSS a limited license to use for operational purposes

We may remove content that violates these Terms.


15. Intellectual Property

All App and website content is owned by MSS.
You receive a limited, non-transferable license to use it for personal purposes.

You may not:

  • Copy

  • Modify

  • Distribute

  • Create derivative works

  • Remove copyright notices

Violations may result in termination and legal action.


16. Installment Payment Terms

By enrolling in an installment plan:

  • You commit to the full program fee.

  • All payments are non-refundable once the program begins.

  • Missed or late payments may result in suspension.

  • Late fees may apply.

  • Cancellations do not cancel future installments.


17. Governing Law & Jurisdiction

  • Canadian participants: Governed by British Columbia law.

  • U.S. participants: Governed by Florida law.

Each party consents to the courts in their respective jurisdiction.

International users must comply with local laws.


18. Termination

18.1 Termination by User

You may stop using the App anytime.

18.2 Termination by MSS

We may suspend or terminate your access for:

  • Violations of these Terms

  • Unsafe or unlawful conduct

  • Misuse of the App

No refunds will be issued for violations.


19. Modifications to Terms

MSS may update these Terms at any time.
Continued use constitutes acceptance of the updated Terms.
